1. Seller Identity

The website www.deskcompliance.com is operated under the brand DeskCompliance by DigitGPT LLC, a company incorporated in the State of Delaware (USA), located at 16192 Coastal Highway, Lewes, Delaware 19958, USA.

2. Purpose

These Terms & Conditions of Sale define the terms for consulting, document engineering, and administrative assistance services for obtaining visas for the Kingdom of Thailand. DeskCompliance acts as a private service provider and administrative agent.

3. Nature of Services & Best-Effort Obligation

DeskCompliance provides premium technical and strategic assistance including:

  • Eligibility audit and situation analysis.
  • File engineering and optimization of supporting documents.
  • Submission assistance and administrative follow-up.

Sovereignty clause: DeskCompliance is bound by a best-effort obligation. The final decision (approval, refusal, or postponement) is exclusively within the sovereignty of the Thai royal authorities. DeskCompliance cannot be held responsible for consular decisions or unforeseeable changes in local immigration regulations.

4. Pricing and Payment Terms

  • Prices are displayed in euros (€) or US dollars ($) on the website or via custom specific quote.
  • Payment is due in full before the start of any file review or service delivery.
  • Third-party fees: Unless explicitly stated otherwise, official consular fees, certified translations, notary fees, and bank processing fees remain the exclusive responsibility of the Client.

5. Client Obligations

The Client undertakes to provide 100% accurate, complete information and authentic documents. The provision of falsified, altered documents or misleading information leads to immediate termination of the contract without refund, and releases DeskCompliance from all legal liability.

6. Right of Withdrawal & Refund Policy

  • Immediate execution: By validating the order, the Client expressly requests the start of service delivery before the end of the legal withdrawal period (14 days) and acknowledges waiving the right of withdrawal.
  • Non-refundable processing fees: In case of cancellation by the Client before final submission to embassies, a flat fee of €149 is retained by DeskCompliance for audit and engineering work already performed.
  • Visa refusal guarantee: In case of visa refusal without client fault, DeskCompliance refunds all fees collected, except official consular fees. No refund is due in case of client fault (forged documents, undeclared background, failure to supply requested papers).

7. Limited Liability

DeskCompliance cannot be held liable for indirect damages (lost airline tickets, accommodation bookings, loss of income, professional delays). The total liability of DeskCompliance is strictly limited to the amount actually paid by the Client for the service concerned.

8. Data Protection (GDPR & Security)

DeskCompliance applies a strict data sovereignty and minimization policy to protect your personal files:

  • Storage: Data is stored on secure servers located in Europe (Google Workspace Enterprise infrastructure, storage guaranteed in Europe).
  • Confidentiality: Access to documents is protected by strong multi-factor authentication (MFA). No client data is ever shared or sold to third parties.
  • Purge Policy: All sensitive documents (passport scans, bank statements, criminal records) are permanently and irreversibly deleted from our cloud servers within 30 days of the final decision notice.

9. Intellectual Property

All content on the website (text, structure, design, graphics, trademarks) is the exclusive property of DigitGPT LLC. Any reproduction, copy or representation, even partial, is strictly prohibited without prior written authorization.

10. Force Majeure

DeskCompliance shall not be held liable for any delay or failure to perform resulting from force majeure, including but not limited to: closure of embassies or consulates, governmental shutdowns, pandemics, natural disasters, or any other event beyond its reasonable control.

11. Mediation and Disputes

In case of dispute, an amicable solution will always be prioritized. If the Client resides in the EU, they may use a consumer mediator free of charge. For clients outside the EU, disputes shall be submitted exclusively to the jurisdiction of the State of Delaware (USA).
